This Privacy Policy explains how Gatsby Media LLC("OffMarket," "we," "us," or "our") collects, uses, and shares information when you use the OffMarket website (offmarket.so), application (app.offmarket.so), and related services (the "Service"). By using the Service, you agree to this Policy.

1. Information we collect

Information you provide

• Account and contact details - your email address and, if provided at checkout, your name.
• Payment information - processed by our payment provider, Stripe. We receive limited billing details (such as your email, subscription status, and the last four digits and brand of your card) but we do not collect or store your full card number.
• Communications - messages you send us, such as support requests.
• Your inputs - search queries, buy-box criteria, saved deals, notes, and other content you enter into the Service.

Information collected automatically

• Usage and device data - pages viewed, actions taken, approximate location, browser and device type, and referring source, collected via cookies and similar technologies.
• Cookies and analytics/advertising technologies - we use analytics and advertising tools including PostHog, Google Analytics, Plausible, and the Meta (Facebook) Pixel to understand traffic and conversions and to measure and improve advertising.

2. How we use information

• to provide, operate, secure, and improve the Service;
• to create and manage your account and process subscriptions and payments;
• to communicate with you about your account, trials, billing, and support;
• to send product updates and marketing (you can opt out of marketing at any time);
• to measure and improve our marketing and advertising, including conversion tracking;
• to detect, prevent, and address fraud, abuse, and security issues;
• to comply with legal obligations and enforce our terms.

3. How we share information

We do not sell your personal information. We share it only as follows:

• Service providers who process data on our behalf, including Stripe (payments), Supabase (authentication and data storage), Resend (email), and analytics/advertising providers (PostHog, Google, Plausible, Meta).
• Legal and safety - when required by law, to respond to legal process, or to protect the rights, property, or safety of OffMarket, our users, or others.
• Business transfers - in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

4. Cookies and your choices

We use cookies and similar technologies for authentication, preferences, analytics, and advertising. You can control cookies through your browser settings; blocking some cookies may affect how the Service works. You can opt out of certain interest-based advertising through your device or ad-platform settings, and out of Google Analytics via Google's opt-out tools.

5. Data retention

We retain your information for as long as your account is active and as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion as described below.

6. Security

We use reasonable administrative, technical, and organizational measures to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

7. Your rights

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, to opt out of certain processing, and to withdraw consent. California residents have rights under the CCPA/CPRA, including the right to know, delete, and correct, and the right not to be discriminated against for exercising those rights; we do not sell personal information. To exercise any right, email support@offmarket.so. We will respond as required by applicable law.

8. Children

The Service is not directed to children under 18, and we do not knowingly collect information from them.

9. International users

We are based in the United States and process information there. If you access the Service from outside the U.S., you consent to the transfer and processing of your information in the United States.

10. Changes to this Policy

We may update this Policy from time to time. We will update the "Last updated" date above and, for material changes, provide additional notice where appropriate.
